Appeal filed in Nevada gold mine, Shoshone dispute

A tribe and environmentalists are appealing a judge's denial of an injunction sought to block a big gold mine in northeast Nevada.

After a four day hearing last month, U.S. District Judge Larry Hicks denied the injunction sought by members of the Western Shoshone and Great Basin Resource Watch against Barrick Gold Corp.'s Cortez Hills Project.

The plaintiff argued the U.S. Bureau of Land Management ignored environmental effects and the religious significance of Mount Tenabo to Western Shoshone when it approved the project late last year.

Hicks denied the motion, ruling they did not present enough evidence to show they'd likely prevail should the case get to trial. A notice to appeal his ruling to the 9th U.S. Circuit Court of Appeals was filed Monday.
